Martin Sieff, de UPI, \u00e9crit ainsi (le <a href=\"http:\/\/www.upi.com\/SecurityTerrorism\/view.php?StoryID=20060630-023359-9261r\" class=\"gen\">30 juin<\/a>) : \u00ab <em>The U.S. Supreme Court ruling blocking the use of military tribunals to try terror suspects sends a clear message around the world: The United States is still a republic, not an empire.<\/em> \u00bb<\/p>\n<\/p>\n<p><p>\tNotre appr\u00e9ciation est que ce jugement n&rsquo;est pas faux dans la forme mais qu&rsquo;il n&rsquo;implique aucun motif automatique de r\u00e9jouissance sur le fond. L&rsquo;appr\u00e9ciation implicite de Sieff est que le syst\u00e8me de la R\u00e9publique porte en soi, d&rsquo;une fa\u00e7on consubstantielle, des vertus qui, par essence et par d\u00e9finition, prendront toujours le dessus. Pour notre compte, nous jugeons qu&rsquo;il s&rsquo;agit d&rsquo;une opinion et nullement d&rsquo;une v\u00e9rit\u00e9, et que cette opinion est largement contest\u00e9e par les faits historiques autant que par la situation actuelle de la Grande R\u00e9publique (l&rsquo;Am\u00e9rique).<\/p>\n<\/p>\n<p><p>\tC&rsquo;est \u00e0 cette lumi\u00e8re, nous semble-t-il, qu&rsquo;il faut regarder le jugement de la Cour Supr\u00eame. Ce jugement confirme l&rsquo;id\u00e9e que l&rsquo;Am\u00e9rique \u00ab <em>is still a republic, not an empire<\/em> \u00bb. Il ne la sauvegarde en rien de quoi que ce soit et l&rsquo;\u00e9tat actuel de la R\u00e9publique n&rsquo;est certainement pas un motif de satisfaction ni d&rsquo;esp\u00e9rance. Nous avons toujours consid\u00e9r\u00e9 que les structures m\u00eames de l&rsquo;Am\u00e9rique, notamment son absence de centralit\u00e9 r\u00e9galienne et la n\u00e9cessit\u00e9 de maintenir une libert\u00e9 formelle pour le fonctionnement de l&rsquo;\u00e9conomie, mettaient ce pays hors de la possibilit\u00e9 de l&rsquo;\u00e9volution vers un mod\u00e8le imp\u00e9rial ou vers une sorte ou l&rsquo;autre de fascisme. Le pouvoir am\u00e9ricaniste est structurellement \u00e9clat\u00e9, avec la part la plus faible faite \u00e0 l&rsquo;ex\u00e9cutif malgr\u00e9 les apparences conjoncturelles. (On trouve un exemple courant de cette situation dans <a href=\"http:\/\/www.dedefensa.org\/article.php?art_id=2746\" class=\"gen\">l&rsquo;incapacit\u00e9<\/a> du pouvoir ex\u00e9cutif de faire ex\u00e9cuter par sa bureaucratie les d\u00e9cisions de transfert de technologies qui satisferaient le Royaume-Uni dans ce cas d&rsquo;une grande importance politique de l&rsquo;avion de combat JSF.)<\/p>\n<\/p>\n<p><p>\tEn Am\u00e9rique r\u00e8gne sans aucun doute le Droit. Cela ne signifie pas que la justice ou\/et la vertu y r\u00e8gnent mais sans aucun doute la technique du contrat et du compromis qui est la d\u00e9finition du fonctionnement du pouvoir am\u00e9ricaniste, et la d\u00e9finition du droit anglo-saxon par cons\u00e9quent. La formule de l&rsquo;\u00c9tat de Droit est une interpr\u00e9tation pompeuse et fausse, dont se gargarisent notamment les historiens et chroniqueurs asserment\u00e9s fran\u00e7ais, pour qualifier un \u00e9tat de compromis \u00e0 passer selon des r\u00e8gles admises par toutes les forces d&rsquo;influence participant au pouvoir. Au-del\u00e0 de cette situation th\u00e9orique qui n&rsquo;est qu&rsquo;un arrangement entre des int\u00e9r\u00eats divers, aucune \u00e9volution maligne n&rsquo;est interdite, comme nous pouvons le constater avec la situation actuelle : ni la d\u00e9cadence, ni la corruption, ni m\u00eame le stade ultime de la structuration maligne d&rsquo;un syst\u00e8me bureaucratique socialement et psychologiquement canc\u00e9rig\u00e8ne.<\/p>\n<\/p>\n<p><p>\tLe jugement de la Cour n&rsquo;est en rien, ni d\u00e9cisif ni m\u00eame d&rsquo;une r\u00e9elle importance par rapport \u00e0 la situation instaur\u00e9e par l&rsquo;administration GW en coop\u00e9ration avec divers autres centres de pouvoir (le Congr\u00e8s, l&rsquo;industrie, les bureaucraties, les <em>lobbies<\/em>, etc.). C&rsquo;est ce qui a \u00e9t\u00e9 aussit\u00f4t mis en \u00e9vidence apr\u00e8s le jugement de la Cour, par des actions aussit\u00f4t lanc\u00e9es par le Congr\u00e8s. Tom Carter, de <em>WSWS.org<\/em>, expose cette \u00e9volution, le <a href=\"http:\/\/www.wsws.org\/articles\/2006\/jul2006\/dems-j01.shtml\" class=\"gen\">1er juillet<\/a> :<\/p>\n<\/p>\n<p><p>\t\u00ab <em>In the aftermath of Thursday&rsquo;s Supreme Court ruling barring the use of military commissions set up by the Bush administration to try detainees at the Guant\u00e1namo detention facility, the White House and Republicans in Congress have initiated a drive to provide congressional sanction for the commissions. Leading Democrats have already signaled that they will cooperate with the Republicans to pass such legislation.<\/em><\/p>\n<\/p>\n<p><p>\t\u00bb <em>Whether any legislation that eventually emerges simply ratifies the existing commissions and the procedures laid down by the Bush administration, or introduces modifications to make the flouting of due process less brazen, the central purpose of the effort is to circumvent the substance, if not the letter, of the Supreme Court&rsquo;s ruling.<\/em> (&#8230;)<\/p>\n<\/p>\n<p><p>\t\u00bb <em>Following the ruling, Senate Armed Services Committee Chairman John Warner (Republican of Virginia) and the ranking Democrat on the committee, Carl Levin of Michigan, announced in a joint statement that the committee would hold hearings on the legal foundations and procedures for military tribunals in preparation for the consideration in September of such legislation as may be required.<\/em><\/p>\n<\/p>\n<p><p>\t\u00bb <em>Senate Judiciary Committee Chairman Arlen Specter (Republican of Pennsylvania) promptly introduced on the Senate floor the Unprivileged Combatant Act, which, he said, would give legislative approval to the existing tribunals while addressing the legal requirements of the Supreme Court ruling. He announced that his committee would hold hearings on the proposal July 11, immediately after the Senate reconvenes following the July 4 Independence Day recess.<\/em><\/p>\n<\/p>\n<p><p>\t\u00bb <em>Patrick Leahy of Vermont, the ranking Democrat on the Judiciary Committee, signaled his willingness to cooperate in passing such legislation. I remain ready to work with the president, as I have repeatedly offered over the years, to ensure that the war on terror is prosecuted consistent with our laws and fundamental values, he said in a statement issued on his web site Thursday.<\/em><\/p>\n<\/p>\n<p><p>\t\u00bb <em>Adam Schiff, a California Democrat on the House Judiciary and International Relations committees, already introduced legislation in June of last year to provide legislative sanction for the Guant\u00e1namo military commissions. A key purpose of Schiff&rsquo;s bill, which was co-sponsored by five other Democrats, is, according to the language of the bill itself, to affirm the authority of the executive branch to detain foreign nationals as unlawful combatants.<\/em><\/p>\n<\/p>\n<p><p>\t\u00bb <em>The rapid-fire response of the White House and both Republican and Democratic congressional leaders to the court ruling makes it clear that they had prepared in advance for a decision unfavorable to the Bush administration. Within minutes of the Supreme Court ruling being handed down, Senator Warner was on hand to give a statement to the press in which he outlined the Republican strategy in Congress. Shortly thereafter, during a joint appearance with the visiting Japanese Prime Minister Junichiro Koizumi, Bush alluded to Warner&rsquo;s remarks and indicated that he would work with Congress to preserve the commissions while conforming to the high court ruling.<\/em> \u00bb<\/p>\n<\/p>\n<p><p>\tSi l&rsquo;on s&rsquo;en rapporte \u00e0 d&rsquo;autres analyses, on peut m\u00eame d\u00e9duire le contraire de ce qu&rsquo;affirment les contempteurs de la d\u00e9cision de la Cour comme sauvegarde d&rsquo;une R\u00e9publique id\u00e9alement vertueuse. Robert Kuttner, de <em>The American Prospect<\/em>, explique le 1er juillet dans une tribune du <a href=\"http:\/\/www.commondreams.org\/views06\/0701-23.htm\" class=\"gen\">Boston Globe<\/a> combien cette d\u00e9cision de la Cour marque un recul de l&rsquo;engagement de cet organisme supr\u00eame par rapport \u00e0 des cas pr\u00e9c\u00e9dents (comparaison faite avec la d\u00e9cision de la Cour contre Nixon en 1974), et combien elle est assortie de consid\u00e9rations qui donnent effectivement le moyen au Pr\u00e9sident et aux forces qui jouent le m\u00eame jeu que lui de contourner sa propre d\u00e9cision (comme Tom Carter l&rsquo;explique plus haut).<\/p>\n<\/p>\n<p><p>\tKuttner :<\/p>\n<\/p>\n<p><p>\t\u00ab <em>But this slender victory for constitutional democracy is nothing like the high court&rsquo;s 1974 ruling, 9 to 0, compelling Richard Nixon to turn over the Watergate tapes. It is crystal clear from the dissent that a hard-core bloc of four justices will defer to Bush, whatever the cost to the Constitution. Chief Justice John Roberts, the missing fourth minority vote in this week&rsquo;s Guantanamo case, had voted while an appeals judge to approve Bush&rsquo;s claims.<\/em> <\/p>\n<\/p>\n<p><p>\t\u00bb <em>The rule of law now hangs by a thread. It depends on the health of an increasingly frail 86-year-old Justice John Paul Stevens, and the willingness of the Court&rsquo;s inconstant swing vote, Anthony Kennedy, to side with the Constitution.<\/em> <\/p>\n<\/p>\n<p><p>\t\u00bb <em>The Court required military trials to follow due process, but did not challenge Bush&rsquo;s doctrine of indefinite detention for enemy combatants. In a concurring opinion, Justice Stephen Breyer wrote that nothing prevents the president from returning to Congress to seek the authority he believes necessary. The risk is that the Republican Congress will take that invitation literally. Congress could legislate military tribunals. Republican leaders are working on legislation to explicitly legalize domestic spying. And with Bush pressing for a line-item veto, Congress could also authorize something close to Bush&rsquo;s signing statements.<\/em> \u00bb <\/p>\n<\/p>\n<p><p>\tSi l&rsquo;on adopte le point de vue du pessimiste,  qui n&rsquo;est jamais qu&rsquo;un optimiste bien inform\u00e9, comme chacun sait,  on observe que la d\u00e9cision de la Cour est une fa\u00e7on pour elle de sauvegarder sa vertu constitutionnaliste sans trop s&rsquo;ali\u00e9ner les autres pouvoirs; que, par ailleurs, le vote et d&rsquo;autres circonstances qui l&rsquo;entourent ont montr\u00e9 au contraire un accroissement du d\u00e9sordre et d&rsquo;une fragile incertitude dans le r\u00f4le d&rsquo;apparent contrepoids aux autres pouvoirs que doit en th\u00e9orie jouer la Cour.<\/p>\n<\/p>\n<p><p>\t&#8230; Mais c&rsquo;est finalement la vraie bonne nouvelle. C&rsquo;est le jour o\u00f9 la Cour Supr\u00eame, ayant elle-m\u00eame atteint le degr\u00e9 final de corruption qui touche les autres pouvoirs de la Grande R\u00e9publique, ne pourra plus jouer son r\u00f4le de faux-masque vertueux pour le syst\u00e8me, que le syst\u00e8me sera vraiment \u00e0 l&rsquo;agonie. Le jour o\u00f9 la Cour donnera son blanc-seing aux folies d&rsquo;un Pr\u00e9sident et de ses complices, nous saurons que la machine, R\u00e9publique ou pas, est sur le point de se faire <em>hara kiri<\/em>.
