De deux fa\u00e7ons, ce matin :<\/p>\n<\/p>\n<p><p>\t Le <em>Guardian<\/em> affirme <a href=\"http:\/\/www.guardian.co.uk\/baefiles\/story\/0,,2102237,00.html\" class=\"gen\">ce matin<\/a> qu&rsquo;il est pratiquement assur\u00e9 que le d\u00e9partement de la justice (DoJ) va ouvrir une enqu\u00eate pour fait de corruption contre BAE. Les Am\u00e9ricains r\u00e9agissent aux derni\u00e8res informations concernant Prince Bandar et sont particuli\u00e8rement exc\u00e9d\u00e9s que le syst\u00e8me bancaire US ait \u00e9t\u00e9 impliqu\u00e9 dans le circuit de corruption. D&rsquo;autre part, les d\u00e9tails sur le r\u00f4le jou\u00e9 <a href=\"http:\/\/www.dedefensa.org\/article.php?art_id=4100\" class=\"gen\">par le MoD<\/a> dans ce circuit ont \u00e9galement jou\u00e9 un r\u00f4le important dans ce qui serait, selon le <em>Guardian<\/em>, une d\u00e9cision acquise \u00e0 99%.<\/p>\n<\/p>\n<p><p>\t\u00ab<em>The US Department of Justice is now virtually certain to open an investigation into BAE under the Foreign Corrupt Practices Act.<\/em><\/p>\n<\/p>\n<p><p>\t\u00bb<em>This would cover the alleged \u00a31bn arms deal payments to Prince Bandar of Saudi Arabia, well-placed sources say.<\/em><\/p>\n<\/p>\n<p><p>\t\u00bb<em>Washington-based sources familiar with the thinking of senior officials at the DoJ, said today it is 99% certain that a criminal inquiry will be opened.<\/em><\/p>\n<\/p>\n<p><p>\t\u00bb<em>Such an investigation would have potentially seismic consequences for BAE, which is trying to take over US arms companies and turn the Pentagon into its biggest customer.<\/em><\/p>\n<\/p>\n<p><p>\t\u00bb<em>The sources say that US officials have been particularly concerned by the allegations published in the Guardian that UK Ministry of Defence officials actively colluded in the payments.<\/p>\n<\/p>\n<p><p>\tOne said: \u00a0\u00bbThe image of all these Bob Cratchits in Whitehall sitting at their high stools processing invoices from Bandar has been a startling one to us.<\/em><\/p>\n<\/p>\n<p><p>\t\u00bb<em>A senior US source told the Guardian today that the allegation that BAE used the US banking system to transfer quarterly payments to accounts at Riggs Bank in Washington, appeared to bring the payments within the ambit of the FCPA.<\/em>\u00bb<\/p>\n<\/p>\n<p><p>\t  Le <em>Financial Times<\/em> donne de son c\u00f4t\u00e9 une <a href=\"http:\/\/www.ft.com\/cms\/s\/6cb445d2-19ed-11dc-99c5-000b5df10621.html\" class=\"gen\">information<\/a> qui semblerait aller en sens inverse puisqu&rsquo;il s&rsquo;agit d&rsquo;une d\u00e9cision du Congr\u00e8s de lever l&rsquo;interdiction faite \u00e0 BAE d&rsquo;effectuer certaines op\u00e9rations d\u00e9pendant de la l\u00e9gislation US \u00e0 cause des soup\u00e7ons de corruption pesant sur BAE. Mais une bonne lecture de la d\u00e9cision n&rsquo;est pas rassurante pour BAE. C&rsquo;est parce que BAE a convaincu le Congr\u00e8s que les op\u00e9rations propos\u00e9es ne d\u00e9pendent pas des activit\u00e9s actuellement plac\u00e9es sous la suspicion de corruption que l&rsquo;autorisation a \u00e9t\u00e9 accord\u00e9e, ce qui implique <em>a contrario<\/em> toute la valeur, aux yeux du Congr\u00e8s, de cette suspicion. However US officials on Wednesday night refused to say whether they were planning to launch a full investigation.<\/em><\/p>\n<\/p>\n<p><p>\t\u00bb<em>Congressional aides said the House and Senate foreign relations committees had lifted the technology transfer blocks after BAE North America said none of the assets involved was the subject of the abortive investigation by Britain&rsquo;s Serious Fraud Office, which was probing allegations the company bribed Saudi officials to win work worth billions of pounds over 20 years.<\/em><\/p>\n<\/p>\n<p><p>\t\u00bb<em>The decision frees up a proposal by Mojave, a BAE business unit, to transfer two A-4N Skyhawk aircraft to the German air force. Other deals involve a technical assistance agreement to upgrade systems on Australian F\/A-18 fighter jets, and a plan by BAE and Japanese partner companies to make transponders.<\/em><\/p>\n<\/p>\n<p><p>\t\u00bb<em>The committees had stepped up scrutiny of BAE last month on news of the formal US government protest in January against the decision to halt the inquiry. BAE has denied wrongdoing.<\/em>\u00bb<\/p>\n<\/p>\n<p><p>\tLes deux journaux font un lien serr\u00e9 entre ces agitations US autour du cas de corruption de BAE et l&rsquo;expansion de BAE aux USA, notamment avec l&rsquo;achat projet\u00e9 de Armor Holdings pour $2,4 milliards. Il est bien entendu \u00e9vident que c&rsquo;est la position et les ambitions de BAE aux USA qui sont en cause dans le cas d&rsquo;une enqu\u00eate de corruption qui ne laverait pas BAE de tout soup\u00e7on,  performance qui para\u00eet difficile. Le <em>Guardian<\/em> donne un historique de diverses pol\u00e9miques qui ont d\u00e9j\u00e0 oppos\u00e9 les USA \u00e0 BAE et au MoD sur d&rsquo;autres affaires de cette sorte, expliquant ainsi un \u00e9ventuel acharnement US contre la firme britannique am\u00e9ricanis\u00e9e.
