{"id":72582,"date":"2010-12-16T16:46:33","date_gmt":"2010-12-16T16:46:33","guid":{"rendered":"https:\/\/new.dedefensa.org\/index.php\/2010\/12\/16\/confusion-et-organisation-autour-du-sort-de-julian-assange\/"},"modified":"2010-12-16T16:46:33","modified_gmt":"2010-12-16T16:46:33","slug":"confusion-et-organisation-autour-du-sort-de-julian-assange","status":"publish","type":"post","link":"https:\/\/new.dedefensa.org\/index.php\/2010\/12\/16\/confusion-et-organisation-autour-du-sort-de-julian-assange\/","title":{"rendered":"Confusion et organisation autour du sort de Julian Assange"},"content":{"rendered":"<p><p>La confusion est consid\u00e9rable autour des diverses circonstances qui entourent l&rsquo;arrestation de Julian Assange, puis la d\u00e9cision de libert\u00e9 sous caution, puis l&rsquo;appel aussit\u00f4t introduit contre cette d\u00e9cision, puis cet appel finalement repoouss\u00e9 et aboutissant (aujourd&rsquo;hui) \u00e0 la confirmation de la libert\u00e9 sous caution. <\/p>\n<\/p>\n<p><p>\tUn article du <em>Guardian<\/em>, ces <a href=\"http:\/\/www.guardian.co.uk\/media\/2010\/dec\/16\/julian-assange-wikileaks\" class=\"gen\">15 et 16 d\u00e9cembre 2010<\/a> (article r\u00e9dig\u00e9 hier soir et rafra\u00eechi par la nouvelle du rejet de l&rsquo;appel contre la libert\u00e9 sous caution) nous donne divers d\u00e9tails qui illustrent cette confusion. Outre les <a href=\"http:\/\/www.dedefensa.org\/article-visa_mastercard_et_la_caution_d_assange_15_12_2010.html\" class=\"gen\">interf\u00e9rences<\/a> des modalit\u00e9s de paiement de la caution, la premi\u00e8re version nous disait que la Su\u00e8de avait introduit cet appel, par la voix de son avocat devant le tribunal. Il s&rsquo;av\u00e8re maintenant que c&rsquo;est le procureur repr\u00e9sentant le gouvernement britannique (<em>Crown Prosecution Service<\/em>, ou CPS) qui a effectivement agi dans ce sens. Le <em>Guardian<\/em>, particuli\u00e8rement bien inform\u00e9, donne les d\u00e9tails des diverses explications qu&rsquo;il a obtenues.<\/p>\n<\/p>\n<p><p>\t\u00ab<em>The decision to have Julian Assange sent to a London jail and kept there was taken by the British authorities and not by prosecutors in Sweden, as previously thought, the Guardian has learned. The Crown Prosecution Service will go to the high court tomorrow to seek the reversal of a decision to free the WikiLeaks founder on bail, made yesterday by a judge at City of Westminster magistrates court.<\/em><\/p>\n<\/p>\n<p><p>\t\u00bb<em>It had been widely thought Sweden had made the decision to oppose bail, with the CPS acting merely as its representative. But today the Swedish prosecutor&rsquo;s office told the Guardian it had not got a view at all on bail and that Britain had made the decision to oppose bail. Lawyers for Assange reacted to the news with shock and said CPS officials had told them this week it was Sweden which had asked them to ensure he was kept in prison.<\/em><\/p>\n<\/p>\n<p><p>\t\u00bb<em>Karin Rosander, director of communications for Sweden&rsquo;s prosecutor&rsquo;s office, told the Guardian: The decision was made by the British prosecutor. I got it confirmed by the CPS this morning that the decision to appeal the granting of bail was entirely a matter for the CPS. The Swedish prosecutors are not entitled to make decisions within Britain. It is entirely up to the British authorities to handle it.<\/em><\/p>\n<\/p>\n<p><p>\t\u00bb<em>As a result, she said, Sweden will not be submitting any new evidence or arguments to the high court hearing tomorrow morning. \u00ab\u00a0The Swedish authorities are not involved in these proceedings. We have not got a view at all on bail.\u00a0\u00bb<\/em><\/p>\n<\/p>\n<p><p>\t\u00bb<em>After the Swedish statement was put to the CPS, it confirmed that all decisions concerning the opposing of bail being granted to Assange had been taken by its lawyers. It said: In all extradition cases, decisions on bail issues are always taken by the domestic prosecuting authority. It would not be practical for prosecutors in a foreign jurisdiction  to make such decisions.<\/em>\u00bb<\/p>\n<\/p>\n<p><p>\tL&rsquo;imbroglio juridique, les informations vraies ou fausses, confirm\u00e9es ou d\u00e9menties, les d\u00e9clarations de deux gouvernements, parfois contradictoires, parfois concordantes,  la confusion est grande autour de l&rsquo;arrestation et du sort de Julian Assange. On y ajoutera les pressions US, \u00e9videmment constantes, qui doivent s&rsquo;exercer aussi bien sur les Britanniques que sur les Su\u00e9dois. Cette situation a pour effet d&rsquo;entretenir la tension autour du sort du fondateur de <em>Wikileaks<\/em> et de susciter de plus en plus d&rsquo;initiatives et de rassemblements en fonction de cette situation. Dans le <em>Guardian<\/em> du <a href=\"http:\/\/www.guardian.co.uk\/commentisfree\/2010\/dec\/16\/wikileaks-fight-for-democracy-open-letter\" class=\"gen\">16 d\u00e9cembre 2010<\/a>, John Pilger (qui a contribu\u00e9 \u00e0 la caution d&rsquo;Assange) prend sous sa plume une lettre ouverte collective, sign\u00e9e de diverses personnalit\u00e9s, et signifgiant un engagement de lutte \u00e0 propos de l&rsquo;affaire Assange et du reste : \u00ab<em>Thus, we pledge to not simply bear witness but to actively participate in this fight  for freedom of speech, for real democracy and for justice. We know this is only the beginning: de-masking the puppeteers facilitates action towards fairer and more just societies<\/em>\u00bb <\/p>\n<\/p>\n<p><p>\tUn autre de ces mouvements a pris forme aux USA, qui rassemblent des personnalit\u00e9s qu&rsquo;on pourrait qualifier de dissidentes, mais appartenant aussi bien \u00e0 la droite qu&rsquo;\u00e0 la gauche. Ce mouvement s&rsquo;attache essentiellement \u00e0 l&rsquo;aspect US de l&rsquo;affaire Assange, en s&rsquo;opposant \u00e0 l&rsquo;intention du gouvernement US de demander l&rsquo;extradition de Julian Assange. We will not accept the manipulation of our legal system to criminalize a journalist; a free and independent press is non-negotiable. The project is planning an aggressive campaign to support Assange and WikiLeaks and has hosted the statement online.<\/em>\u00bb<\/p>\n<\/p>\n<p><p>\tIl faut noter la rapidit\u00e9 avec laquelle s&rsquo;est amorc\u00e9 ce regroupement droite-gauche de la dissidence US. C&rsquo;est un fait sans aucun doute remarquable, qui mesure \u00e0 la fois la pression des \u00e9v\u00e9nements et la perception de l&rsquo;affaire Assange (de la crise <em>Cablegate<\/em> en g\u00e9n\u00e9ral). On peut consid\u00e9rer qu&rsquo;il s&rsquo;agit \u00e9ventuellement d&rsquo;un \u00e9v\u00e9nement sans gu\u00e8re de pr\u00e9c\u00e9dent aux USA, que cette union de la dissidence des deux bords, qui est un but d\u00e9sesp\u00e9r\u00e9ment poursuivi depuis la guerre en Irak par diverses personnalit\u00e9s.<\/p>\n<\/p>\n<p><p>\tEn un sens, l&rsquo;aspect affaire Assange de la crise g\u00e9n\u00e9rale <em>Cablegate<\/em> est une excellente opportunit\u00e9,  cela appr\u00e9ci\u00e9 d&rsquo;un il tactique, n\u00e9cessairement froid et sans rendre justice (au propre et au figur\u00e9) \u00e0 Julian Assange et \u00e0 son sort.
