Le PCLOB est compl\u00e8tement int\u00e9gr\u00e9 dans l&rsquo;administration mais ne d\u00e9pend en principe d&rsquo;aucune autorit\u00e9 de tutelle contraignante. Il n&rsquo;est devenu op\u00e9rationnel que tr\u00e8s r\u00e9cemment apr\u00e8s une mise en place complexe, charg\u00e9e de pol\u00e9miques et de chausse-trappes. Le New York <em>Time<\/em> et le Washington <em>Post<\/em> ont publi\u00e9 aujourd&rsquo;hui les principaux constats d&rsquo;un rapport de 238 pages qui leur est parvenu, disons, en pr\u00e9-publication. Le NYT du <a href=\"http:\/\/www.nytimes.com\/2014\/01\/23\/us\/politics\/watchdog-report-says-nsa-program-is-illegal-and-should-end.html\" class=\"gen\">23 janvier 2014<\/a> \u00e9crit que le PCLOB juge le programme d&rsquo;\u00e9coute g\u00e9n\u00e9ralis\u00e9e et de stockage de donn\u00e9es de la NSA compl\u00e8tement ill\u00e9gal et estime qu&rsquo;il doit cesser :<\/p>\n<\/p>\n<p><p>\t\u00ab<em>An independent federal privacy watchdog has concluded that the National Security Agency&rsquo;s program to collect bulk phone call records has provided only minimal benefits in counterterrorism efforts, is illegal and should be shut down.<\/em> [] <em>The report is likely to inject a significant new voice into the debate over surveillance, underscoring that the issue was not settled by a high-profile speech President Obama gave last week. Mr. Obama consulted with the board, along with a separate review group that last month delivered its own report about surveillance policies. But while he said in his speech that he was tightening access to the data and declared his intention to find a way to end government collection of the bulk records, he said the program&rsquo;s capabilities should be preserved.<\/em>\u00bb<\/p>\n<\/p>\n<p><p>\tC&rsquo;est la premi\u00e8re manifestation publique du PCLOB. Le rapport a \u00e9t\u00e9 lu par Obama avant son discours sur la NSA (voir le <a href=\"http:\/\/www.dedefensa.org\/article-la_crise_snowden_nsa_la_lumi_re_du_bavardage_de_bho_18_01_2014.html\" class=\"gen\">18 janvier 2014<\/a>), ce qui place le pr\u00e9sident et le PCLOB dans des positions curieusement antagonistes, ou bien d&rsquo;une fa\u00e7on logique si l&rsquo;on consid\u00e8re le climat de division g\u00e9n\u00e9rale et de paralysie du pouvoir \u00e0 Wahington.<\/p>\n<\/p>\n<p><p>\tLe <em>Guardian<\/em> du <a href=\"http:\/\/www.theguardian.com\/world\/2014\/jan\/23\/nsa-barack-obama-phone-data-collection-illegal-privacy-board\" class=\"gen\">23 janvier 2014<\/a> rapporte la satisfaction des parlementaires r\u00e9formistes (en m\u00eame temps que la fureur des pro-NSA, dont le pr\u00e9sident de la commission de la Chambre sur le renseignement, Mike Rogers). Il semble bien que le rapport du PCLOB doive \u00eatre consid\u00e9r\u00e9 comme un atout d\u00e9cisif pour les partisans du <em>Freedom Act<\/em>, le projet de loi anti-NSA en cours d&rsquo;\u00e9laboration \u00e0 la Chambre. (Le rapport du PCLOB va encore plus loin dans le sens des restrictions que le <em>Freedom Act<\/em>.)<\/p>\n<\/p>\n<p><p>\t\u00ab<em>Senator Patrick Leahy, the Vermont Democrat who chairs the judiciary committee and co-authored the USA Freedom Act, said the report added to the growing chorus that wanted to end the phone metadata dragnet. The report reaffirms the conclusion of many that the Section 215 bulk phone records program has not been critical to our national security, is not worth the intrusion on Americans&rsquo; privacy, and should be shut down immediately, Leahy said. Representative Adam Schiff, a California Democrat on the intelligence committee, predicted the report would spell the final end of the government&rsquo;s bulk collection of telephone metadata<\/em>\u00bb<\/p>\n<\/p>\n<p><p>\tLe PCLOB doit publier un autre rapport la semaine prochaine, compl\u00e9tant celui que le NYT et le <em>Post<\/em> ont fait conna\u00eetre, sur les pratiques de la NSA dans le domaine ext\u00e9rieur du point de vue de ses retomb\u00e9es au niveau US. Une assertion gravissime du rapport du PCLOB est que l&rsquo;activit\u00e9 gargantuesque de la NSA depuis 9\/11 n&rsquo;a eu que tr\u00e8s peu d&rsquo;effets du point de vue de la lutte antiterroriste. Le rapport a \u00e9t\u00e9 approuv\u00e9 par trois des cinq membres du PCLOB (les deux dissidents \u00e9tant des juges nomm\u00e9s par l&rsquo;administration GW Bush), ce qui pourrait provoquer des remous du c\u00f4t\u00e9 des pro-NSA cherchant des arguments pour contrer le rapport.<\/p>\n<\/p>\n<p><p>\tDans tous les cas, cette intervention du PCLOB accro\u00eet l&rsquo;intensit\u00e9 du d\u00e9bat aux USA, les divisions \u00e0 l&rsquo;int\u00e9rieur des institutions washingtoniennes, et la vigueur de la bataille autour de la NSA par cons\u00e9quent. Le d\u00e9bat est d&rsquo;ampleur nationale et affecte d\u00e9sormais tous les centres du pouvoir washingtonien.
