Lorsqu&rsquo;on entre dans le d\u00e9tail, on d\u00e9couvre une formidable structure politique, sociologique et culturelle d\u00e9ploy\u00e9e depuis plusieurs mois par un gouvernement qui a un soutien massif du Parlement. Bien entendu, le fait fondamental se divise en deux remarques qui sont \u00e9minemment et radicalement contradictoire selon l&rsquo;habituel mode de pens\u00e9e :<\/p>\n<p>&bull; par rapport au courant dominant de la globalisation et du n\u00e9o-lib\u00e9ralisme, cette structure est d&rsquo;une orientation compl\u00e8tement \u00ab\u00a0dissidente\u00a0\u00bb et par cons\u00e9quent parfaitement r\u00e9volutionnaire ;<\/p>\n<p>&bull; par rapport au courant dominant de la globalisation et du n\u00e9o-lib\u00e9ralisme, le gouvernement qui la d\u00e9ploie, d&rsquo;orientation sociale-d\u00e9mocrate, devrait \u00eatre compl\u00e8tement en accord avec elle alors qu&rsquo;il se pose en compl\u00e8te \u00ab\u00a0dissidence\u00a0\u00bb.<\/p>\n<\/p>\n<p><p>Il s&rsquo;agit de simples constats absolument irr\u00e9futables, qui conduisent \u00e0 observer avec une certaine stup\u00e9faction ce pays, le Danemark, que nous d\u00e9crivions dans le texte d\u00e9j\u00e0 cit\u00e9 de cette fa\u00e7on : &laquo; &#8230; <em>dans les m\u00eames couloirs bruxellois, c&rsquo;est une ic\u00f4ne<\/em>&#8230; [&#8230;] <em>Petit pays o&ugrave; il n&rsquo;y a pas vraiment une tr\u00e8s grosse chose de pourrie quoi qu&rsquo;on dise ; superbement rang\u00e9, ordonn\u00e9, remarquablement propre-sur-lui, roulant en bicyclette, scrupuleux respect des r\u00e8gles d&rsquo;or du droit des gens et de la morale-moraline \u00e0-la-Onfray, tol\u00e9rant, ouvert, bien dans sa peau lib\u00e9rale et d\u00e9mocrate &ndash; on en perd son souffle.<\/em> &raquo;<\/p>\n<\/p>\n<p><p>Si l&rsquo;on veut reprendre la fameuse citation, l&rsquo;on dira qu'\u00a0\u00bbil y a quelque chose d&rsquo;extraordinaire au Royaume du Danemark\u00a0\u00bb. Parce que l&rsquo;\u00e9v\u00e9nement s&rsquo;\u00e9value sur un certain \u00ab\u00a0temps long\u00a0\u00bb (selon les mesures du syst\u00e8me de la communication), nous ne pouvons encore dire de quoi il s&rsquo;agit exactement, ni en d\u00e9crire le comment ni le pourquoi ; il importe pour l&rsquo;instant d&rsquo;en rester \u00e0 ce \u00ab\u00a0fait fondamental\u00a0\u00bb et d&rsquo;en d\u00e9tailler les modalit\u00e9s. Le texte de Soeren Kern repris ci-dessous est remarquablement complet \u00e0 cet \u00e9gard et l&rsquo;on reprend ici l'\u00a0\u00bb<em>abstract<\/em>\u00a0\u00bb qui l&rsquo;introduit en offrant les points principaux de l&rsquo;analyse.<\/p>\n<\/p>\n<blockquote class=\"normal\" style=\"font-size:1.05em\">\n<p><p> &laquo; <em>&bull; Le Parlement danois a adopt\u00e9 une nouvelle loi qui permettra au gouvernement d&rsquo;expulser des demandeurs d&rsquo;asile vers des pays ext\u00e9rieurs \u00e0 l&rsquo;Union europ\u00e9enne afin que leur dossier soit examin\u00e9 \u00e0 l&rsquo;\u00e9tranger. Cette loi est largement consid\u00e9r\u00e9e comme un premier pas vers le d\u00e9placement du processus d&rsquo;examen des demandes d&rsquo;asile au-del\u00e0 des fronti\u00e8res danoises.<\/em><\/p>\n<\/p>\n<p><p>&raquo; <em>&bull; \u00ab\u00a0Le Danemark s&rsquo;engage \u00e0 trouver des solutions nouvelles et durables aux probl\u00e8mes actuels de migration et de r\u00e9fugi\u00e9s qui touchent les pays d&rsquo;origine, de transit et de destination. Le syst\u00e8me d&rsquo;asile actuel est injuste et contraire \u00e0 l&rsquo;\u00e9thique en incitant des enfants, des femmes et des hommes \u00e0 s&#8217;embarquer dans des voyages dangereux le long des routes migratoires, tandis que les trafiquants d&rsquo;\u00eatres humains gagnent des fortunes.\u00a0\u00bb &ndash; Mattias Tesfaye, ministre danois de l&rsquo;immigration.<\/em><\/p>\n<\/p>\n<p><p>&raquo; <em>&bull; \u00ab\u00a0La criminalit\u00e9 de bande n&rsquo;a en aucun cas sa place au Danemark. Lorsque des \u00e9trangers ou des personnes auxquelles nous avons accord\u00e9 la citoyennet\u00e9 danoise participent \u00e0 la criminalit\u00e9 impitoyable des gangs, c&rsquo;est une expression fondamentale de m\u00e9pris pour la soci\u00e9t\u00e9 dont ils font partie. Par cons\u00e9quent, c&rsquo;est une bonne nouvelle que le Parlement ait adopt\u00e9 aujourd&rsquo;hui le projet de loi du gouvernement visant \u00e0 donner la possibilit\u00e9 de r\u00e9voquer la citoyennet\u00e9 en cas de crime grave commis par un gang au d\u00e9triment des int\u00e9r\u00eats vitaux de l&rsquo;&Eacute;tat. C&rsquo;est un objectif du gouvernement de faire en sorte que les Danois puissent \u00eatre en s\u00e9curit\u00e9 dans leur vie quotidienne.\u00a0\u00bb &ndash; Le ministre de la Justice Nick H&aelig;kkerup.<\/em><\/p>\n<\/p>\n<p><p>&raquo; <em>&bull; Le Parlement danois a approuv\u00e9 une toute premi\u00e8re loi sur le rapatriement qui autorise le gouvernement \u00e0 expulser les demandeurs d&rsquo;asile d\u00e9bout\u00e9s et les autres migrants en situation irr\u00e9guli\u00e8re dans le pays&#8230; Le gouvernement danois a renforc\u00e9 les r\u00e8gles relatives \u00e0 la citoyennet\u00e9&#8230; Le gouvernement danois a annonc\u00e9 un ensemble de nouvelles propositions visant \u00e0 lutter contre les \u00ab\u00a0soci\u00e9t\u00e9s parall\u00e8les religieuses et culturelles\u00a0\u00bb au Danemark&#8230; Le Parlement danois a approuv\u00e9 une nouvelle loi qui interdit aux gouvernements \u00e9trangers de financer des mosqu\u00e9es au Danemark&#8230; Le Parlement danois a approuv\u00e9 une interdiction du port du voile int\u00e9gral islamique dans les espaces publics.<\/em><\/p>\n<\/p>\n<p><p>&raquo; <em>&bull; \u00ab\u00a0Nous esp\u00e9rons que les gens cesseront de demander l&rsquo;asile au Danemark\u00a0\u00bb &ndash; Le d\u00e9put\u00e9 Rasmus Stoklund<\/em>. &raquo;<\/p>\n<\/p>\n<\/blockquote>\n<p><p>Pour mieux mettre en \u00e9vidence ce caract\u00e8re d&rsquo;exceptionnalit\u00e9 de la d\u00e9marche danoise, on retiendra qu&rsquo;autant d&rsquo;\u00eatre une structure l\u00e9gislative visant \u00e0 stopper l&rsquo;\u00e9migration de masse, il est une structure l\u00e9gislative visant \u00e0 r\u00e9organiser la soci\u00e9t\u00e9 danoise avec l&rsquo;immigration qui y est d&rsquo;ores et d\u00e9j\u00e0 install\u00e9e. Il l&rsquo;est dans un sens sociologique certes, mais surtout, selon notre point de vue, du point de vue culturel. Il tend \u00e0 se pr\u00e9senter comme protecteur des us &#038; coutumes danois, du mode de vie, de la conception m\u00eame de la vie de la soci\u00e9t\u00e9 danoise en fonction des caract\u00e8res culturels danois.<\/p>\n<\/p>\n<p><p>Ainsi, parmi les tr\u00e8s nombreuses initiatives mises en chantier par le gouvernement, on retiendra les mesures r\u00e9pressives (dont le retrait de la nationalit\u00e9 quand elle a \u00e9t\u00e9 donn\u00e9e) sp\u00e9cifiquement contre des activit\u00e9s ill\u00e9gales et criminelles pratiqu\u00e9es par des immigr\u00e9s ; et surtout, les mesures de restriction de concentrations de populations immigr\u00e9es \u00ab\u00a0non-occidentales\u00a0\u00bb, caract\u00e9ris\u00e9es par leurs religions et leurs cultures initiales, qui peuvent \u00eatre per\u00e7ues comme organisant des &laquo; <em>soci\u00e9t\u00e9s parall\u00e8les religieuses et culturelles<\/em> &raquo;. On cite ci-dessous l&rsquo;\u00e9v\u00e9nement signal\u00e9 dans le texte, et provenant d&rsquo;interventions directes de ministres du gouvernement danois. (Il faut signaler que le ministre de l&rsquo;Immigration Mattias Tesfaye, bien s&ucirc;r au c&oelig;ur du projet g\u00e9n\u00e9ral, est lui-m\u00eame fils d&rsquo;immigr\u00e9 \u00ab\u00a0non-occidental\u00a0\u00bb, son p\u00e8re \u00e9tant un &Eacute;thiopien immigr\u00e9 au Danemark.)<\/p>\n<\/p>\n<blockquote class=\"normal\" style=\"font-size:1.05em\">\n<p><p>&laquo; <strong><em>17 mars 2021<\/em><\/strong><em>. Le gouvernement danois <a href=\"https:\/\/www.gatestoneinstitute.org\/17197\/denmark-parallel-societies\">a annonc\u00e9<\/a> un ensemble de nouvelles propositions visant \u00e0 lutter contre les \u00ab\u00a0soci\u00e9t\u00e9s parall\u00e8les religieuses et culturelles\u00a0\u00bb au Danemark. L&rsquo;une des pierres angulaires de ce plan consiste \u00e0 plafonner le pourcentage d&rsquo;immigrants \u00ab\u00a0non occidentaux\u00a0\u00bb et de leurs descendants vivant dans un quartier r\u00e9sidentiel donn\u00e9. L&rsquo;objectif est de pr\u00e9server la coh\u00e9sion sociale dans le pays en encourageant l&rsquo;int\u00e9gration et en d\u00e9courageant l&rsquo;auto-s\u00e9gr\u00e9gation ethnique et sociale<\/em>. &raquo;<\/p>\n<\/p>\n<\/blockquote>\n<p><p>Comme nous l&rsquo;envisagions \u00e9galement dans le texte cit\u00e9, il \u00e9tait \u00e0 pr\u00e9voir que cette nouvelle politique danoise serait l&rsquo;objet de critiques furieuses de la part des repr\u00e9sentants et organisations d&rsquo;orientation globaliste et n\u00e9o-lib\u00e9rales, dans le sens le plus progressiste o&ugrave; on l&rsquo;entend aujourd&rsquo;hui, assez proche du mouvement wokeniste que nous suivons depuis un an avec la plus grande attention. Cela n&rsquo;a \u00e9videmment pas tard\u00e9, bien au contraire.<\/p>\n<\/p>\n<p><p>Il s&rsquo;agit essentiellement de l&rsquo;Union Europ\u00e9enne et d&rsquo;organisations de l&rsquo;ONU charg\u00e9es des r\u00e9fugi\u00e9s et de l&rsquo;immigration. Pour l&rsquo;instant, il n&rsquo;y a pas eu, \u00e0 notre connaissance, de r\u00e9actions significatives de la part d&rsquo;autres pays de l&rsquo;UE en tant que tels. Il est manifeste qu&rsquo;il y aura sans aucun doute des r\u00e9actions hostiles qui iront jusqu&rsquo;aux plus hautes instances juridiques, notamment europ\u00e9ennes, comme le signalent aussi bien l&rsquo;auteur de l&rsquo;article que nombre de lecteurs dans la rubrique \u00ab\u00a0commentaires\u00a0\u00bb.<\/p>\n<\/p>\n<p><p>Ces lecteurs, parmi lesquels on devine sous des noms d&#8217;emprunts des personnalit\u00e9s de diff\u00e9rents pays confront\u00e9s \u00e0 ces questions migratoires, soulignent tous l&rsquo;importance fondamentale de l&rsquo;orientation danoise, y voyant un \u00ab\u00a0mod\u00e8le\u00a0\u00bb pour affronter la crise migratoire, notamment pour les pays europ\u00e9ens. (Actuellement, les musulmans, qui forment l&rsquo;essentiel de cette migration de masse, comptent pour 5,5% de la population danoise. En cas de \u00ab\u00a0migration-z\u00e9ro\u00a0\u00bb, vers laquelle veut tendre le gouvernement, ils seraient 7,6% en 2050. En cas de poursuite de l&rsquo;actuelle politique des \u00ab\u00a0portes ouvertes\u00a0\u00bb et de migration massive, ils seraient 16% en 2050.)<\/p>\n<\/p>\n<blockquote class=\"normal\" style=\"font-size:1.05em\">\n<p><p>&laquo; <em>Les partisans de l&rsquo;immigration massive ont critiqu\u00e9 la nouvelle loi danoise. La Commission europ\u00e9enne, le puissant organe administratif de l&rsquo;UE, <a href=\"https:\/\/www.reuters.com\/world\/europe\/eu-executive-has-fundamental-concerns-about-new-danish-migration-law-2021-06-03\/\">a d\u00e9clar\u00e9<\/a> qu&rsquo;elle fait na&icirc;tre  des \u00ab\u00a0pr\u00e9occupations fondamentales\u00a0\u00bb concernant l&rsquo;expulsion des demandeurs d&rsquo;asile vers des pays hors d&rsquo;Europe :<\/em><\/p>\n<p>&raquo; <em>\u00ab\u00a0Le traitement externe des demandes d&rsquo;asile soul\u00e8ve des questions fondamentales concernant tant l&rsquo;acc\u00e8s aux proc\u00e9dures d&rsquo;asile que l&rsquo;acc\u00e8s effectif \u00e0 la protection. Cette proc\u00e9dure est impossible en vertu des r\u00e8gles existantes de l&rsquo;UE ou des propositions du nouveau pacte pour l&rsquo;immigration et l&rsquo;asile.\u00a0\u00bb<\/em><\/p>\n<\/p>\n<p><p>&raquo; <em>D&rsquo;autres ont accus\u00e9 le Danemark de chercher \u00e0 \u00ab\u00a0exporter\u00a0\u00bb la proc\u00e9dure d&rsquo;asile. Gillian Triggs, haut-commissaire adjoint du HCR, l&rsquo;agence des Nations unies pour les r\u00e9fugi\u00e9s, <a href=\"https:\/\/www.euronews.com\/2021\/06\/03\/denmark-passes-a-law-to-send-its-asylum-seekers-outside-of-europe\">a averti<\/a> que \u00ab\u00a0de telles pratiques sapent les droits de ceux qui cherchent la s\u00e9curit\u00e9 et la protection, les diabolisent et les punissent et peuvent mettre leur vie en danger.\u00a0\u00bb<\/em><\/p>\n<\/p>\n<p><p>&raquo; <em>Shabia Mantoo, porte-parole mondiale du HCR, <a href=\"https:\/\/www.euronews.com\/2021\/06\/03\/denmark-passes-a-law-to-send-its-asylum-seekers-outside-of-europe\">a ajout\u00e9<\/a> que l&rsquo;agence \u00ab\u00a0reste fermement oppos\u00e9e aux initiatives nationales qui transf\u00e8rent de force les demandeurs d&rsquo;asile vers d&rsquo;autres pays et sapent les principes de la protection internationale des r\u00e9fugi\u00e9s.&quot;<\/em><\/p>\n<\/p>\n<p><p>&raquo; <em>Dans une <a href=\"https:\/\/www.euronews.com\/2021\/06\/03\/denmark-passes-a-law-to-send-its-asylum-seekers-outside-of-europe\" target=\"_blank\">interview<\/a> accord\u00e9e \u00e0 la publication \u00ab\u00a0Euronews\u00a0\u00bb, Nikolas Feith Tan, chercheur principal \u00e0 l&rsquo;Institut danois des droits de l&rsquo;homme, a d\u00e9clar\u00e9 que le projet du Danemark d&rsquo;h\u00e9berger les demandeurs d&rsquo;asile en dehors de ses fronti\u00e8res repr\u00e9sente \u00ab\u00a0un changement fondamental\u00a0\u00bb dans le fonctionnement du syst\u00e8me de protection internationale :<\/em><\/p>\n<p>&raquo; <em>\u00ab\u00a0Tant qu&rsquo;\u00e0 pr\u00e9sent, la protection des r\u00e9fugi\u00e9s est essentiellement territoriale. Si vous atteignez le Danemark, c&rsquo;est \u00e0 lui qu&rsquo;il incombe de d\u00e9terminer si vous \u00eates un r\u00e9fugi\u00e9 ou non et, si vous l&rsquo;\u00eates, de vous accorder une protection. La nouvelle l\u00e9gislation bouleverse cette id\u00e9e d&rsquo;asile territorial.\u00a0\u00bb<\/em><\/p>\n<\/p>\n<p><p>&raquo; <em>M. Tan a d\u00e9clar\u00e9 que le transfert des demandeurs d&rsquo;asile \u00e0 l&rsquo;\u00e9tranger ne violait pas en principe le droit international, mais que le gouvernement devait n\u00e9anmoins s&rsquo;attendre \u00e0 \u00eatre poursuivi devant les tribunaux danois et la Cour europ\u00e9enne des droits de l&rsquo;homme.<\/em><\/p>\n<\/p>\n<p><p>&raquo; <em>Tesfaye <a href=\"https:\/\/www.ft.com\/content\/7917b3e5-8dd9-4bb6-9d5d-81506c38c9c4\">a d\u00e9clar\u00e9<\/a> qu'\u00a0\u00bbun objectif cl\u00e9\u00a0\u00bb \u00e9tait de r\u00e9duire le nombre de demandeurs d&rsquo;asile spontan\u00e9s\u00a0\u00bb au Danemark :<\/em><\/p>\n<\/p>\n<p><p>&raquo; <em>\u00ab\u00a0Le syst\u00e8me d&rsquo;asile actuel a \u00e9chou\u00e9. Il est inefficace et injuste. Des enfants, des femmes et des hommes se noient en M\u00e9diterran\u00e9e ou sont maltrait\u00e9s le long des routes migratoires, tandis que les trafiquants d&rsquo;\u00eatres humains gagnent des fortunes.\u00a0\u00bb<\/em> &raquo;<\/p>\n<\/p>\n<\/blockquote>\n<p><p>Le gouvernement danois agit dans cette affairer \u00e0 la lumi\u00e8re de deux crises : celle des immigrants, en 2015, et celle du Covid19 d\u00e9j\u00e0 vieille de seize mois et qui a mis en question le syst\u00e8me actuel de circulation on contr\u00f4l\u00e9e au niveau international. Il affiche son intention, parmi les mesures envisag\u00e9es, de r\u00e9tablir un certain contr\u00f4le de ses fronti\u00e8res, ce qui le place frontalement en d\u00e9saccord avec le monde des accords de Schengen. De nombre de points de vue, le Danemark se dirige donc vers un d\u00e9marquage important de r\u00e8gles fondamentales de l&rsquo;UE, le mettant plus proche d&rsquo;une Hongrie que de ses habituels compagnons de route.<\/p>\n<\/p>\n<p><p>Le Danemark est bien un cas inhabituel : fortement tenu dans les griffes am\u00e9ricanistes (<a href=\"https:\/\/www.dedefensa.org\/article\/nsa-maman-bobo\">salut de la NSA<\/a>), suivant aussi fortement les tendances du wokenisme dans les domaines soci\u00e9taux classiques (f\u00e9minisme notamment), son soudain d\u00e9marquage des r\u00e8gles de soumission \u00e0 la migration ouvre un champ nouveau de r\u00e9flexion. Il s&rsquo;agit ici de savoir si l&rsquo;on peut \u00ab\u00a0tron\u00e7onner\u00a0\u00bb son adh\u00e9sion aux r\u00e8gles de la postmodernit\u00e9 en rompant avec l&rsquo;une des plus importantes d&rsquo;entre elles aussi radicalement, tout en s&rsquo;en tenant aux autres.<\/p>\n<\/p>\n<p><p>Il s&rsquo;agit \u00e9galement de savoir si un tel cas que celui du Danemark, au c&oelig;ur du Syst\u00e8me, litt\u00e9ralement, pourra r\u00e9sister aux pressions contradictoires intenses de ce Syst\u00e8me, que ce soit des organisations supranationales, des ONG, d&rsquo;autres pays ; ou si, au contraire, ses actes vont constituer un \u00ab\u00a0mod\u00e8le\u00a0\u00bb qui pourrait tenter certains autres pays de l&rsquo;UE. Il s&rsquo;agit alors de comprendre que le cas danois n&rsquo;est pas seulement une question int\u00e9rieure pour ce pays, mais bien un facteur suppl\u00e9mentaire de trouble au sein du Syst\u00e8me, une pouss\u00e9e crisique suppl\u00e9mentaire, qui accroit encore la confusion et la chaos, et m\u00eame \u00ab\u00a0encore plus\u00a0\u00bb dans la mesure o&ugrave; il s&rsquo;agit d&rsquo;un \u00ab\u00a0bon \u00e9l\u00e8ve\u00a0\u00bb dot\u00e9 d&rsquo;une excellente \u00ab\u00a0r\u00e9putation\u00a0\u00bb d&rsquo;alignement sur le Syst\u00e8me.<\/p>\n<\/p>\n<p><p>Nous n&rsquo;avons aucune id\u00e9e et certainement pas la moindre pr\u00e9tention de savoir sur l&rsquo;initiative danoise a des chances de r\u00e9ussir, si elle a des possibilit\u00e9s de faire des \u00e9mules, etc. Mais nous avons certainement une occasion de plus, un argument de plus, pour avancer notre argument sur la d\u00e9sint\u00e9gration du Syst\u00e8me. The legislation is widely seen as a first step toward moving the country&rsquo;s asylum screening process beyond Danish borders.<\/p>\n<\/p>\n<p><p>The law, proposed by the Social Democrat-led government, is aimed at discouraging frivolous asylum applications. It has been greeted with fury by those who favor mass migration, presumably out of fear that other EU countries may now follow Denmark&rsquo;s lead.<\/p>\n<\/p>\n<p><p>Denmark, which already has some of the most restrictive immigration policies in Europe, is at the vanguard of European efforts to preserve local traditions and values in the face of mass migration, runaway multiculturalism, and the systematic encroachment of political Islam.<\/p>\n<\/p>\n<p><p>An amendment to the Aliens Act, <a href=\"https:\/\/www.ft.dk\/samling\/20201\/lovforslag\/l226\/index.htm\" target=\"_blank\">approved<\/a> on June 3 by 70 votes to 24, authorizes the government to enter into agreements with non-EU countries (so-called third countries) to allow it to &quot;transfer third-country nationals and stateless persons who apply for asylum in Denmark to the third country in question for the purpose of substantive processing of asylum applications.&quot;<\/p>\n<\/p>\n<p><p>Danish Immigration Minister Mattias Tesfaye, a Social Democrat and the son of an Ethiopian immigrant, <a href=\"https:\/\/www.ft.com\/content\/7917b3e5-8dd9-4bb6-9d5d-81506c38c9c4\" target=\"_blank\">told<\/a> the <em>Financial Times<\/em> that Denmark had &quot;identified a handful of countries,&quot; mostly in Africa, that might be open to hosting migrant reception centers.<\/p>\n<\/p>\n<p><p>In April, Tesfaye <a href=\"https:\/\/um.dk\/da\/nyheder-fra-udenrigsministeriet\/newsdisplaypage\/?newsID=9C7C43B9-9F39-4735-991B-0E3577BAE826\" target=\"_blank\">signed<\/a> a &quot;Memorandum of Understanding&quot; with Rwanda regarding &quot;cooperation on asylum and migration issues.&quot; The document raised speculation that Denmark wants to transfer migrants to the East African country, which has a tradition of hosting refugees. The memorandum spelled out the Danish government&rsquo;s <a href=\"https:\/\/um.dk\/da\/~\/media\/um\/danish-site\/documents\/danida\/mou%20on%20asylum%20and%20migration%20issues%20between%20rw%20and%20dk.pdf\" target=\"_blank\">long-term objective<\/a>:<\/p>\n<\/p>\n<p><p>&quot;Denmark is committed to finding new and sustainable solutions to the present migration and refugee challenges that affect countries of origin, transit and destination. The current asylum system is unfair and unethical by incentivizing children, women and men to embark on dangerous journeys along the migratory routes, while human traffickers earn fortunes.<\/p>\n<\/p>\n<p><p>&quot;There is a need to finding new ways of addressing the migration challenges by promoting a fairer and more humane asylum system based on a comprehensive approach. This includes addressing the root causes of irregular migration, providing more and better protection of refugees in the regions of conflict and increasing assistance to host nations, countries of origin and transit &mdash; along the migratory routes &mdash; in order to improve border management, strengthen asylum systems and fight human smuggling.<\/p>\n<\/p>\n<p><p>&quot;It is also the vision of the Danish Government that the processing of asylum applications should take place outside of the EU in order to break the negative incentive structure of the present asylum system.&quot;<\/p>\n<\/p>\n<p><p>Advocates of mass migration have criticized Denmark&rsquo;s new law. The European Commission, the EU&rsquo;s powerful administrative arm, <a href=\"https:\/\/www.reuters.com\/world\/europe\/eu-executive-has-fundamental-concerns-about-new-danish-migration-law-2021-06-03\/\" target=\"_blank\">said<\/a> that it had &quot;fundamental concerns&quot; about deporting asylum seekers to countries outside of Europe:<\/p>\n<\/p>\n<p><p>&quot;External processing of asylum claims raises fundamental questions about both the access to asylum procedures and effective access to protection. It is not possible under existing EU rules or proposals under the new pact for migration and asylum.&quot;<\/p>\n<\/p>\n<p><p>Others have accused Denmark of seeking to &quot;export&quot; the asylum process. Gillian Triggs, assistant high commissioner of UNHCR, the United Nations&rsquo; refugee agency, <a href=\"https:\/\/www.euronews.com\/2021\/06\/03\/denmark-passes-a-law-to-send-its-asylum-seekers-outside-of-europe\" target=\"_blank\">warned<\/a> that &quot;such practices undermine the rights of those seeking safety and protection, demonize and punish them and may put their lives at risk.&quot;<\/p>\n<\/p>\n<p><p>UNHCR global spokesperson Shabia Mantoo <a href=\"https:\/\/www.euronews.com\/2021\/06\/03\/denmark-passes-a-law-to-send-its-asylum-seekers-outside-of-europe\" target=\"_blank\">added<\/a> that the agency &quot;remains firmly opposed to national initiatives that forcibly transfer asylum-seekers to other countries and undermine the principles of international refugee protection.&quot;<\/p>\n<\/p>\n<p><p>In an <a href=\"https:\/\/www.euronews.com\/2021\/06\/03\/denmark-passes-a-law-to-send-its-asylum-seekers-outside-of-europe\" target=\"_blank\">interview<\/a> with <em>Euronews<\/em>, Nikolas Feith Tan, a senior researcher at the Danish Institute for Human Rights, said that Denmark&rsquo;s plan to house asylum seekers outside its borders represents &quot;a fundamental shift&quot; in how the international protection system functions:<\/p>\n<\/p>\n<p><p>&quot;Up until now, refugee protection has been primarily territorial. If you reach Denmark, then Denmark is responsible for both assessing whether you are a refugee or not, and if you are a refugee, then for granting you protection. The new legislation shifts that idea of territorial asylum.&quot;<\/p>\n<\/p>\n<p><p>Tan said that transferring asylum seekers abroad in principle does not violate international law, but that the government should still expect be sued in Danish courts and at the European Court of Human Rights.<\/p>\n<\/p>\n<p><p>Tesfaye <a href=\"https:\/\/www.ft.com\/content\/7917b3e5-8dd9-4bb6-9d5d-81506c38c9c4\" target=\"_blank\">said<\/a> that &quot;a key aim&quot; was to reduce the number of &quot;spontaneous&quot; asylum seekers to Denmark:<\/p>\n<\/p>\n<p><p>&quot;The current asylum system has failed. Children, women and men are drowning in the Mediterranean or are abused along the migratory routes, while human traffickers earn fortunes.&quot;<\/p>\n<\/p>\n<p><h3 class=\"subtitleset_c.deepgreen\" style=\"color:#75714d; font-size:1.25em\">Other Measures to Curb Mass Migration<\/h3>\n<\/p>\n<p><p>Since assuming power in June 2019, the government of Danish Prime Minister Mette Frederiksen has introduced a raft of measures aimed at curbing mass migration. The measures build on those implemented by previous governments.<\/p>\n<\/p>\n<p><p><strong>June 3, 2021<\/strong>. The Danish Parliament <a href=\"https:\/\/www.ft.dk\/samling\/20201\/lovforslag\/L230\/som_vedtaget.htm\" target=\"_blank\">approved<\/a> by 78 votes to 16 a new law that authorizes the government to revoke Danish citizenship from immigrants who are members of criminal gangs. The law is aimed at tackling a surge in migration-linked violent crime. The amendment to the Citizenship Act <a href=\"https:\/\/www.ft.dk\/samling\/20201\/lovforslag\/L230\/som_vedtaget.htm\" target=\"_blank\">allows<\/a>for the &quot;denial of citizenship for certain forms of serious gang crimes considered detrimental to the vital interests of the State.&quot; The law applies only to dual nationals and not to gang members who, by losing their Danish citizenship, would become stateless. The new law, which is not retroactive, enters into force on July 1, 2021.<\/p>\n<\/p>\n<p><p>Minister of Justice Nick H&aelig;kkerup <a href=\"https:\/\/uim.dk\/nyheder\/nu-kan-domstolene-tage-statsborgerskabet-fra-bandekriminelle\" target=\"_blank\">said<\/a>:<\/p>\n<\/p>\n<p><p>&quot;Gang crime in no way belongs in Denmark. When foreigners or persons to whom we in Denmark have granted Danish citizenship participate in the gangs&rsquo; ruthless crime, it is a fundamental expression of contempt for the society of which they are a part. Therefore, it is good news that Parliament has today passed the government&rsquo;s bill to provide the opportunity to revoke citizenship in the event of serious gang crime to the serious detriment of the state&rsquo;s vital interests. It is a goal for the government to ensure that Danes can be safe in their everyday lives. When the gangs challenge that security, it must have noticeable consequences.&quot;<\/p>\n<\/p>\n<p><p><strong>May 26, 2021<\/strong>. The Danish Parliament <a href=\"https:\/\/www.ft.dk\/samling\/20201\/lovforslag\/l203\/index.htm\" target=\"_blank\">approved<\/a> by 67 votes to 26 a first-ever Repatriation Law which authorizes the government to deport failed asylum seekers and other migrants illegally in the country. The law allows the government to monitor foreigners&rsquo; mobile phones in order to more easily identify and deport them.<\/p>\n<\/p>\n<p><p>The law was approved amid <a href=\"https:\/\/www.bt.dk\/samfund\/udlaendinge-rejser-hjem-for-dine-penge-men-kommer-bare-tilbage-igen\" target=\"_blank\">reports<\/a> that migrants who had been paid between 100,000 and 225,000 Danish kroner ($16,000 and $37,000) by the Danish government to leave the country took the money but then disappeared without actually leaving. Others took the money and left the country and later returned.<\/p>\n<\/p>\n<p><p>Minister for Foreign Affairs and Integration Mattias Tesfaye <a href=\"https:\/\/uim.dk\/nyheder\/nu-er-danmarks-forste-hjemrejselov-vedtaget\" target=\"_blank\">said<\/a>:<\/p>\n<\/p>\n<p><p>&quot;We have too many foreigners without legal residence in Denmark who do not return home. It is unsustainable. Both for the individual and for the Danish state, which must spend money on accommodating these people&#8230;. The penalties have been increased for those with deportation orders who do not comply with their control obligations. Now we have taken the next step towards a coherent repatriation policy. It is intended to help more foreigners without legal residence to return to their home countries. The Danish government <a href=\"https:\/\/www.retsinformation.dk\/eli\/retsinfo\/2021\/9298\" target=\"_blank\">tightened<\/a> citizenship rules. In future, individuals with criminal records will be excluded from obtaining Danish citizenship. Individuals found guilty of committing immigration or social security fraud must wait for six years for their citizenship application to be considered. The new rules also introduced an employment requirement. Applicants must have been in full-time employment or have been self-employed for at least three years and six months within the previous four years. Five questions about Danish values have been added to the citizenship test. A cornerstone of the plan includes capping the percentage of &quot;non-Western&quot; immigrants and their descendants dwelling in any given residential neighborhood. The aim is to preserve social cohesion in the country by encouraging integration and discouraging ethnic and social self-segregation.<\/p>\n<\/p>\n<p><p><strong>March 9, 2021<\/strong>. The Danish Parliament <a href=\"https:\/\/www.gatestoneinstitute.org\/17167\/denmark-mosques-foreign-funds\" target=\"_blank\">approved<\/a> a new law that bans foreign governments from financing mosques in Denmark. The measure is aimed at preventing Muslim countries, particularly Qatar, Saudi Arabia and Turkey, from promoting Islamic extremism in Danish mosques and prayer facilities.<\/p>\n<\/p>\n<p><p><strong>March 9, 2021<\/strong>. The Danish Parliament <a href=\"https:\/\/www.ft.dk\/samling\/20201\/lovforslag\/l126a\/index.htm\" target=\"_blank\">approved<\/a> by 96 votes to 0 a new law that bans religious marriages of minors and forced marriages. Islamic preachers and others who conduct such marriages now face up to two years in prison and deportation from Denmark. The same goes for parents who allow their children enter into a Sharia marriage. The penalty for detaining a person in a forced marriage was increased to four years in prison. The law also authorizes the government to withdraw the passports of children if there is reason to believe that they are being sent abroad to be married, regardless of whether the marriage is legally valid. The law bans the use of Islamic <em>nikah<\/em> marriage contracts which often make it difficult for Muslim women to seek a divorce. The new law entered into force on March 15, 2021.<\/p>\n<\/p>\n<p><p><strong>February 18, 2021<\/strong>. The Danish government <a href=\"https:\/\/uim.dk\/nyheder\/2021\/2021-02\/omkring-350-syriske-flygtninges-behov-for-beskyttelse-skal-genvurderes\" target=\"_blank\">announced<\/a> that it would review the residency status of 350 Syrian migrants from Syria. The move came after the Danish Refugee Board <a href=\"https:\/\/fln.dk\/da\/Nyheder\/Nyhedsarkiv\/2021\/18022021\" target=\"_blank\">decided<\/a> that the Rif Damascus region of Syria is now safe and that there is no longer a basis for granting or extending temporary residence permits.<\/p>\n<\/p>\n<p><p>Minister for Foreign Affairs and Integration Mattias Tesfaye <a href=\"https:\/\/uim.dk\/nyheder\/2021\/2021-02\/omkring-350-syriske-flygtninges-behov-for-beskyttelse-skal-genvurderes\" target=\"_blank\">said<\/a>:<\/p>\n<\/p>\n<p><p>&quot;Denmark has been open and honest from day one. We have made it clear to the Syrian refugees that their residence permit is temporary. It can be withdrawn if protection is no longer needed. With the Refugee Board&rsquo;s decisions this week, the authorities will now review the pile of cases from the same province. This is good. We must give people protection for as long as it is needed. But when conditions in the home country improve, a former refugee should return home and re-establish a life there.&quot;<\/p>\n<\/p>\n<p><p><strong>October 3, 2020<\/strong>. The government <a href=\"https:\/\/nyheder.tv2.dk\/politik\/2020-10-04-regeringen-vil-tappe-afviste-asylansogeres-telefoner\" target=\"_blank\">proposed<\/a> a new Repatriation Law to ensure that more rejected asylum seekers were sent home. At least 1,100 rejected asylum seekers in Denmark do not have the right to reside in the country, and more than 200 rejected asylum seekers have remained Denmark for a more than five years. The measures include paying failed asylum seekers 20,000 Danish kroner (&euro;2,700; $3,600) to leave the country.<\/p>\n<\/p>\n<p><p><strong>September 11, 2020<\/strong>. The government <a href=\"https:\/\/nyheder.tv2.dk\/politik\/2020-09-10-regeringen-skaber-migrationsambassador\" target=\"_blank\">created<\/a> a new ambassadorial post and a task force to work to establish migrant reception centers in third countries outside of the European Union &mdash; in Libya, Tunisia or Morocco.<\/p>\n<\/p>\n<p><p><strong>May 31, 2018<\/strong>. The Danish Parliament <a href=\"https:\/\/www.gatestoneinstitute.org\/12420\/denmark-approves-burka-ban\" target=\"_blank\">approved<\/a> a ban on Islamic full-face veils in public spaces. The law, sponsored by the center-right government in power at the time, and backed by the Social Democrats and the Danish People&rsquo;s Party, passed by 75 votes to 30. Anyone found wearing a <em>burka<\/em> (which covers the entire face) or a <em>niqab<\/em> (which covers the entire face except for the eyes) in public in Denmark is subject to a fine of 1,000 Danish kroner (&euro;134; $163); repeat offenders could be fined 10,000 Danish kroner. In addition, anyone found to be requiring a person through force or threats to wear garments that cover the face could be fined or face up to two years in prison.<\/p>\n<\/p>\n<p><p><strong>January 26, 2016<\/strong>. The Danish Parliament <a href=\"https:\/\/www.ft.dk\/RIpdf\/samling\/20151\/lovforslag\/L87\/20151_L87_som_vedtaget.pdf\" target=\"_blank\">adopted<\/a> several measures aimed at reducing the number of asylum seekers arriving in Denmark: The reintroduction of the requirement that only refugees with the highest potential for integration into Danish society be accepted; an increase in time requirement to three years for family reunifications for asylum seekers; an increase in time requirement before the awarding of permanent residency status; additional integration requirements, including the ability to prove language skills, before permanent residency can be attained; permanent and temporary residency status were made easier to lose; the introduction of fees to apply for family reunification and to convert temporary residence permit to permanent residence permit; a 10% reduction in economic aid to asylum seekers; police were given power to confiscate from asylum seekers items of value to support the cost of their stay; asylum seekers were required to live in special housing centers.<\/p>\n<\/p>\n<p><h3 class=\"subtitleset_c.deepgreen\" style=\"color:#75714d; font-size:1.25em\">Changing Demographics<\/h3>\n<\/p>\n<p><p>Denmark, which has a population of 5.8 million, received approximately 40,000 asylum applications during the past five years, <a href=\"https:\/\/www.statista.com\/statistics\/575213\/quarterly-number-of-asylum-applications-in-denmark\/\" target=\"_blank\">according<\/a> to data compiled by Statista. Most of the applications received by Denmark, a predominately Lutheran country, were from migrants from Muslim countries in Africa, Asia and the Middle East.<\/p>\n<\/p>\n<p><p>In recent years, Denmark has also permitted significant non-asylum immigration, especially from non-Western countries. Denmark is now home to sizeable immigrant communities from Syria (35,536); Turkey (33,111); Iraq (21,840); Iran (17,195); Pakistan (14,471); Afghanistan (13,864); Lebanon (12,990) and Somalia (11,282), <a href=\"https:\/\/www.statista.com\/statistics\/571909\/number-of-immigrants-in-denmark-by-country-of-origin\/\" target=\"_blank\">according<\/a> to Statista.<\/p>\n<\/p>\n<p><p>Muslims currently comprise approximately 5.5% of the Danish population, <a href=\"https:\/\/www.pewforum.org\/2017\/11\/29\/europes-growing-muslim-population\/\" target=\"_blank\">according<\/a> to the Pew Research Center. Under a &quot;zero migration scenario,&quot; the Muslim population is projected to reach 7.6% by 2050; with a &quot;medium migration scenario,&quot; it is forecast to hit 11.9% by 2050; and under a &quot;high migration scenario,&quot; Muslims are expected to comprise 16% of the Danish population by 2050, <a href=\"https:\/\/www.pewforum.org\/2017\/11\/29\/europes-growing-muslim-population\/\" target=\"_blank\">according<\/a> to Pew.<\/p>\n<\/p>\n<p><p>As in other European countries, mass migration has resulted in increased crime and social tension. We cannot promise zero asylum seekers, but we can establish the vision for a new asylum system, and then do what we can to implement it. We must be careful that not too many people come to our country, otherwise our social cohesion cannot exist.
